The EU Data Protection Regulation is being put into place to take over from the EU Data Protection Directive, which we discussed in our earlier post.

The new EU legal regime for data protection that was adopted in 2016 rests on multiple foundations, including the EU Charter of Fundamental Rights, secondary legislation (the main instrument being the EU General Data Protection Regulation 2016/679 or GDPR), Member State law, and relevant judgments of the Court of Justice of the EU. In May 2018, the EU implemented the General Data Protection Regulation (GDPR) which became the new legal backbone on data protection and privacy in the EU. GDPR is an extensive piece of legislation which covers many areas of the digital sphere, and, because of the nature of EU law, the regulation was applied to every member state within the EU. This directive is part of the so-called “New Deal for Consumer” (see here), a package of legislative reforms designed to revise existing EU consumer laws.
